Condominio issue

I have a holiday home flat in a small block of three flats.  Two of the flat owners, both Italians, want to install a lift in the block.  I have been asked if I wish to share in the cost of installation (nearly €40k).  There is no 'amministratore'. The building's usual maintenance costs are met equally by the three of us but, given that we use the flat maybe just four or five weeks in the year and I am on the first floor, I've said no.   I have concerns that a lift may impact adversely (there are no drawings currently) on the aesthetic of the internal, communal area of the building.    I have read that changes to communal areas in condomini now require 4/5 majority support which doesn't help much in this case.  I would be grateful for any information as to whether they can go ahead with the project without my consent.

Neil, my advice to you would be to consult an Avvocato in the first instance, to see how you stand Legally. Also different Comunes have different interpretations on various regulations it is worth finding out how they stand on 'Permessos' for this type of work.

Unless its a listed building, the aestheticss are usually totally subsumed to the luxury of a lift.   The various recent laws and incentives allow a lift to be bunged in where usually youd never allow it, and if one of your neighbours is registered disabled it will be difficult to stop.  HOwever you need to ask someone who knows about condominial law as to whether they need your consent or not.  Good Luck.

I've never lived in a block of flats with a lift so there's also concern about the noise - especially at late at night / early morning.  The building was never built with a lift in mind so the acoustics could be an issue - not to mention any liabilities concerning accidents resulting from poor maintenance etc.  Even if we have refused to participate, I'm not sure we would be exempt from any responsibility in law.

Neil, I think you should contact a lawyer or at least Council to check on regulations. In some countries it is compulsory to install lifts if there is at least 1 neighbour over the age of 70. I am right in the middle of changing from a platform to an elevator in our own building in Spain as the entrance hall is impossible to handle with a wheelchair. Esthetically very beautiful, but highly impractical.
We had an architect drawing a project and it looks extremely well.
